Общие условия выполнения переводческих работ
**Принятие заказа**
• Сроки выполнения письменных и машинописных работ согласовываются с исполнителем.
• Заказ принимается только в случае, если бюро переводов считает возможным его качественное выполнение в желаемый заказчиком срок с учетом квалификации и навыков переводчиков, ранее поступивших заказов и нормального времени, необходимого для выполнения перевода.
• Бюро переводов предоставляет письменное предложение с указанием предполагаемой стоимости работы и сроков выполнения.
• Бюро переводов вправе запросить предоплату за перевод.
• Договор считается заключённым после того, как заказчик акцептовал письменное предложение и оплатил счёт на предоплату. С этого момента заказ считается принятым бюро и начинается его выполнение.
**Отмена заказа**
• В случае отмены заказа на письменный перевод по причинам, не зависящим от бюро переводов, после получения подтверждения о принятии заказа и при условии, что работа уже начата, заказчик оплачивает фактически выполненную на момент отмены работу в полном объёме. Объём выполненной работы рассчитывается исходя из фактически переведённого объёма текста пропорционально согласованной цене.
**Оплата счетов**
• Срок оплаты всех счетов составляет 3 календарных дня, если иное не согласовано и не указано в счёте.
**Ответственность бюро переводов**
• Бюро переводов выполняет все работы добросовестно, в соответствии со своими лучшими знаниями и возможностями.
• Возможные претензии по выполненным работам должны быть представлены в письменной форме с соответствующим обоснованием в течение 7 календарных дней со дня получения работы. Более поздние или необоснованные претензии не принимаются. В случае обоснованной претензии бюро переводов вправе прежде всего устранить недостатки работы.
• Бюро переводов несёт материальную ответственность исключительно в пределах стоимости выполненной переводческой работы. Бюро переводов не несёт ответственности за косвенный ущерб, упущенную выгоду или нематериальный вред.
• Бюро переводов не несёт ответственности за решения государственных органов, нотариусов, судов или иных учреждений в части принятия перевода.
• Бюро переводов обязуется сохранять конфиденциальность содержания документов заказчика.
**Ответственность заказчика**
• Заказчик несёт ответственность за достоверность предоставленных исходных данных, имён, дат, номеров и иной информации.
Бюро переводов оставляет за собой право при необходимости изменять прейскурант. Изменения прейскуранта не распространяются на уже подтверждённые заказы.
Tõlketööde teostamise üldtingimused
**Tellimuse vastuvõtmine**
• Kirjalike tööde ja masinakirjatööde tähtaegades lepitakse kokku töö vastuvõtjaga.
• Tellimus võetakse vastu ainult juhul, kui tõlkebüroo peab võimalikuks selle kvaliteetset täitmist tellija soovitud tähtajaks, võttes arvesse tõlkijate kvalifikatsiooni ja oskusi, eelnevalt laekunud tellimusi ning tõlketööde teostamiseks vajalikku normaalaega.
• Tõlkebüroo esitab kirjaliku pakkumuse töö eeldatava maksumuse ja teostamise tähtaegade kohta.
• Tõlkebüroo võib küsida ettemaksu tõlke eest.
• Leping loetakse sõlmituks pärast seda, kui tellija on kirjaliku pakkumuse aktsepteerinud ning tasunud ettemaksuarve. Tellimus loetakse büroo poolt vastuvõetuks ja seda asutakse täitma.
**Tellimuse tühistamine**
• Kirjaliku tõlke tellimuse tühistamisel tõlkebüroost mitteolenevail põhjustel pärast seda, kui tõlkebüroolt on saadud kinnitus tellimuse vastuvõtmise kohta ning tööd on juba asutud teostama, tasub tellija tühistamise hetkeks juba teostatud töö eest täies ulatuses. Teostatud töö maht arvestatakse tegelikult tõlgitud tekstimahu alusel proportsionaalselt kokkulepitud hinnaga.
**Arvete tasumine**
• Kõigi arvete tasumise tähtaeg on 3 kalendripäeva, kui ei ole kokku lepitud ja arvele märgitud teisiti.
**Tõlkebüroo vastutus**
• Tõlkebüroo teostab kõik tööd oma parimate oskuste ja võimaluste kohaselt.
• Võimalikud pretensioonid teostatud tööde kohta tuleb esitada kirjalikult koos asjakohaste põhjendustega 7 kalendripäeva jooksul arvates töö kättesaamise kuupäevast. Hilisemaid või põhjendamata pretensioone vastu ei võeta. Põhjendatud pretensiooni korral on tõlkebürool õigus esmalt töö parandada.
• Tõlkebüroo vastutab teostatud töö eest materiaalselt üksnes teostatud tõlketöö hinna ulatuses. Tõlkebüroo ei vastuta kaudse kahju, saamata jäänud tulu ega mittevaralise kahju eest.
• Tõlkebüroo ei vastuta riigiasutuste, notarite, kohtute või muude institutsioonide otsuste eest seoses tõlke aktsepteerimisega.
• Tõlkebüroo kohustub hoidma tellija dokumentide sisu konfidentsiaalsena.
**Tellija vastutus**
• Tellija vastutab esitatud lähteandmete, nimede, kuupäevade, numbrite ja muu info õigsuse eest.
Tõlkebüroo jätab endale õiguse vajadusel hinnakirja muuta. Hinnakirja muudatused ei mõjuta juba kinnitatud tellimusi.
General Terms and Conditions for Translation Services
**Order Acceptance**
• Deadlines for written and typed translations are agreed upon with the service provider.
• An order is accepted only if the translation agency considers it possible to complete it with the required quality within the timeframe requested by the client, taking into account the translators' qualifications and skills, previously received orders, and the normal time required to complete the translation.
• The translation agency provides a written quotation indicating the estimated cost of the work and the completion time.
• The translation agency reserves the right to request an advance payment for the translation.
• The contract is deemed concluded once the client has accepted the written quotation and paid the advance invoice. From that moment, the order is considered accepted by the agency and its execution begins.
**Order Cancellation**
• In the event of cancellation of a written translation order for reasons not attributable to the translation agency, after confirmation of acceptance of the order and provided that the work has already begun, the client shall pay in full for the work completed up to the time of cancellation. The volume of completed work shall be calculated based on the actually translated portion of the text proportionally to the agreed price.
**Payment of Invoices**
• The payment term for all invoices is 3 calendar days, unless otherwise agreed and stated in the invoice.
**Liability of the Translation Agency**
• The translation agency performs all work in good faith and to the best of its knowledge and ability.
• Any claims regarding completed work must be submitted in writing with proper justification within 7 calendar days from the date of receipt of the work. Late or unjustified claims will not be accepted. In the case of a justified claim, the translation agency shall primarily have the right to remedy the deficiencies in the work.
• The translation agency's financial liability is limited exclusively to the cost of the translation work performed. The agency shall not be liable for indirect damages, loss of profit, or non-material damage.
• The translation agency shall not be responsible for decisions of government authorities, notaries, courts, or other institutions regarding the acceptance of a translation.
• The translation agency undertakes to maintain the confidentiality of the client's documents.
**Client's Liability**
• The client is responsible for the accuracy of the provided source data, names, dates, numbers, and other information.
The translation agency reserves the right to amend the price list if necessary. Changes to the price list shall not apply to orders that have already been confirmed.
